So, you want to file a law-suit against a cruise line! First of all, Lorraine says “good luck with that!”
Cruise ships are protected by a myriad of laws and jurisdictions, not to mention the “limitations of liabilities” as stated in their cruise contracts (have you ever actually read one before clicking the “accept” button?)
But – some people do try – and some of these allegations make for interesting reading. First of all, if you have too much to drink and fall down the stairs, is that the ship’s fault? While there are some suits that attempt to apply “dram-shop” laws to ships, it’s very difficult – again, given the myriad of jurisdictions.
Some of the more frivolous suits Lorraine has read include one where a couple sued for full refund of their cruise cost PLUS “mental distress” because they were unhappy with the food and entertainment and as a result had suffered great emotional trauma.
Or, how about the group of single men who filed complaining that there were not enough single women onboard their cruise – only to be followed a few weeks later by one filed by a group of single women who complained just the opposite! Hullo – do people think a cruise ship is the “dating game?”
What about the man (who after losing the “sexy man” contest) filed suit some three months following his cruise alleging that he had burned is feet on the pool deck and had suffered “irreparable damages” – sour grapes?
Probably Lorraine’s favorite is the elderly woman who cruised regularly from Miami and on every other cruise experienced a “slip-and-fall.” The line would offer her a free cruise on which she remained perfectly safe – but – she would pay for the following cruise and – you guessed it – “slip-and-fall!”
If you are injured (or Lord forbid, die) on a cruise as a direct result of the ship’s negligence, you have a legitimate cause of action (the internet is full of cruise litigation attorneys who are ready to take your case) – otherwise skip the “frivolity!”
